Philadelphia Turned Down 150 Chinese Investors for Its EB5 Investment Project

Chinese millionaires turned away: The Convention Center board says the money presents too many issues.
By Jennifer Lin and Marcia Gelbart

Close to 150 Chinese millionaires want to help Philadelphia expand its Convention Center, but the center’s board wants no part of their cash.

That has left the potential investors more than a little frustrated.

For the Chinese, the money represents a legal way to expedite access to U.S. “green cards” for permanent residency. Adhering to the requirements of a nearly 20-year-old federal immigration program, they have each plunked down $500,000 in an escrow account at a U.S. bank.

For the state, that money - $73.5 million - could be a cheap way for the Convention Center to borrow funds to cover some of the expansion’s construction costs, which are projected to surge over the $700 million budgeted. (Under the loan program, the money would be repaid, over five years, at a remarkably low interest rate of 2.5 percent.)

But for now the Convention Center, as cash-starved as it is, has no interest in the foreign funds.

“We considered it. We looked at it. But it was kind of a bridge too far . . . too complex for us to consider,” Buck Riley, chairman of the 15-member Convention Center Authority, said last week. “Right now, it is a dead issue.”

Another board member said the board was hesitant to get involved with what seemed like “immigration policy.”

Known in Philadelphia as the “Welcome Fund,” the little-known loan program has been administered jointly since 2003 by the Philadelphia Industrial Development Corp. (PIDC), a city-related nonprofit economic-development agency, and CanAm Enterprises, a New York firm that has structured immigrant investor deals since 1987, mostly in Canada.

PIDC identifies potential borrowers; CanAm seeks out investors. Approved investors receive conditional green cards.

Within two years, they become eligible for permanent green cards, if, among other things, their money spurred jobs. Under the Philadelphia program, 10 new jobs must be created for every $500,000 invested.

To date, the foreign funds have helped pay for 21 projects in Philadelphia totaling $148 million. Among those receiving investment dollars are Comcast Corp. ($26 million), Temple University Health System ($13 million), August Aerospace Corp. ($15 million), the law firm of Duane Morris ($6 million), and Stephen Starr’s Continental Mid-Town restaurant ($3 million).

“We owe $33 billion of debt on our balance sheet, so if we have an opportunity to borrow some money at 1 or 2 percent, yes, we’re going to do it,” said Comcast executive David L. Cohen.

With $73.5 million sitting in a bank account, the Convention Center project would have been the largest, by far.

“Investors like the Convention Center project. I feel very sad about this. Everybody is getting angry,” Dennis Chou said in an interview last week in Shanghai. Based in an office in a high-rise on Beijing Road, Chou works for CanAm, marketing the fund to would-be investors in the Asia-Pacific region.

Chou said he was told last February to begin marketing the Convention Center to investors, and he did - holding informational sessions about the center and Philadelphia throughout China.

Quickly, 147 investors were lined up, but with no movement since then, he said the fund’s credibility was under fire. “When people come in, I have to say, sorry, sorry. I don’t know how to explain to our customers.”

Indeed, CanAm’s president, Tom Rosenfeld, said that if the Convention Center deal collapsed, “it would hurt the whole program.”

In an interview from his New York office, Rosenfeld acknowledged there was a risk in raising the money before the Convention Center approved the deal.

But he said he did so after discussions with officials from the Rendell administration and PIDC. “The state is financing the construction. Clearly they have a say in it.”

Although the authority was not involved in those early conversations, Rosenfeld said, “the assumption was once they understood the program and the benefits, and that it was not harmful, they would vote for this thing.”

Michael Masch, Pennsylvania budget secretary until a few weeks ago, did not return calls last week.

But he voiced support for the loan program as recently as June 3 in a letter to the authority. By his estimates, he wrote, the low-cost loan could save the authority $6 million to $8 million on interest payments.

Peter Longstreth, president of PIDC, said, “Some of the investors may have gotten a little bit ahead of the deal. . . . The fact there are funds in an escrow for a period of time is quite typical.”

The Convention Center has taken no formal vote on the program and has more or less shelved it for the foreseeable future.

“It did not go over well. It seemed something outside our realm,” said board member David Woods, chief of staff to Senate Majority Leader Domenic Pileggi (R., Delaware).

“People were concerned they were dealing with immigration policy while they should really be focused on financing for the Convention Center.”

Still, Rosenfeld maintains hope that the investors’ efforts will not be futile, particularly since final construction costs remain unknown. “I’m not taking this to be a dead issue,” he said. “This is a great program that doesn’t cost the city or state any money, so shouldn’t Philadelphia benefit from it in a way that can complete construction of the Convention
Center?”

South African Trade Mission Coming to the Midwest July 21-22, 2008

South Africa is Minnesota’s biggest trading partner on the African continent. Exports from Minnesota to South Africa have increased from $32.1 million in 2003 to 61.7 million dollars in 2007. The Council on Great Lakes Governors described their 2007 mission to South Africa as very positive. Richard Zurba a representative of the Council describes the market as:

“…a fast adopter of new, innovative and high-tech imports. American technological innovations combined with a currently low U.S. dollar allows American companies to compete favorably against domestic and international competition in that market. South Africa’s economy has been experiencing rapid growth as business and consumer confidence, as well as the stock market, have been at record highs.”

There has been a steady flow of activity between Minnesota and the South African Consulate since the beginning of 2006. This interaction has resulted in a number seminars conducted in collaboration with the Minnesota Trade Office. Other events included South Africa’s participation in the Pan African Trade and Investment Summit held in Minnesota as well as a flagship skills development project between Hennipin Technical College and the South African National Tooling Initiative. These activities culminated in the launch of the SA-Minnesota Business Council. As a result of all this excitement that was generated the Deputy Director General (DDG) of the Department of Trade and Industry, Mr. Iqbal Sharma and the Office of the Presidency decided to undertake a trade mission to Minnesota.

The objective of the trade mission is to support the activities that are currently gaining momentum between Minnesota and South Africa and to strengthen the relationship between businesses in Minnesota and those in South Africa. He will also use this occasion to discuss the latest developments in the market. The DDG will also use this opportunity to discuss some of the challenges South Africa is faced with and to share some of the solutions that the government is working on to address these challenges. This mission will also serve as a way of reaching out to Small, medium and large companies to invite them to look at South Africa as way to expand their businesses on the continent. It is a well known fact that South Africa is the gateway into sub-Saharan Africa and the World Bank stated that the region is set to grow at an astonishing 6% this year, despite the sluggishness of the global economy. South Africa will soon be in a position to provide Midwest companies with duty free access into the Middle East, India and China as a result of free trade agreements that are currently being discussed between South Africa and these countries. Already US companies in South Africa are benefitting from the African Growth and Opportunities Act (AGOA) that allows for selective African products to enter the US market duty free.

The DDG will be accompanied by regional investment promotion agencies and Industrial Development Zones, who will present a number of select bankable projects currently available in their regions. These agencies will provide details on accessing these projects; they will discuss the funding sources available and provide information on the incentives in their regions.
The program will run over two days and the draft schedule will be formatted as follows:

Day 1:
Breakfast session on Doing Business in Minnesota
One to One meetings and Site visits

Lunch seminar
Cocktail reception

Day 2.
Breakfast session with MD Donaldson South Africa (panel discussion)

Defendory 2006 attracted 32,000 professional visitors from 84 countries, including 98 official government and armed forces delegations from 51 countries. Defendory 2006 hosted 440 exhibitors from 30 countries, including approximately 50 from the United States.

The trade mission will target a broad range of aerospace, defense, and safety and security products and services, and will consist of customized one-on-one appointments at the Defendory exhibit site between U.S. participants and Greek customers/business partners, as well as Turkish customers/ business partners. Delegation members may wish to maximize their time in the region by taking advantage of the optional stop in Israel before the mission starts in Greece.

The goal of the mission will be to match participating U.S. companies with pre-screened agents, distributors, representatives, licensees, buyers, and joint venture partners, and where appropriate, arrange for appointments with government officials, traditionally large purchasers of products and services in the highlighted sectors. Consumers in Greece, Turkey and Israel have a strong affinity for U.S. products and services in these sectors.

Commercial Setting:

Greece:
Greece’s allocation of gross domestic product (GDP) for defense is the highest in the European Union (EU). A partner in the North Atlantic Treaty Organization (NATO), Greece is continuing to modernize the Hellenic Armed Forces and shift its force structure toward smaller, more flexible formations. To achieve this, the government has announced plans to spend more than $3 billion by 2011, in addition to the $8 billion it has spent in recent years on defense equipment.

Greece provides U.S. defense firms with excellent opportunities as it pursues a number of high-priority programs, including new frigates, helicopters, missiles, fighters and “new generation” trainer aircraft. It is estimated that U.S. firms could capture up to $2 billion in business under this modernization program. To take full advantage of these opportunities, U.S. firms must understand the complexities of the Greek market, including its often-unpredictable tendering process, as well as the competition from the EU and other areas. In this regard, a local consultant or partner is essential.

The terrorist attacks in New York, Madrid and London, increasing attacks on businesses, and the recent attack on the U.S. Embassy in Athens, led to an important change in Greece’s – and other countries’ – attitudes towards security and counter-terrorism. The necessity for more and better security has resulted in increased market potential associated with the upgrading of Greek airport and port security, to be funded from the Greek national budget, EU funds, the Interregional Plan, and public-private partnerships.

Opportunities for U.S. firms exist in a number of projects in various airport and port safety and security sub-sectors. The Greek civil aviation structure consists of 82 commercial airports, of which 38 are under the jurisdiction of the Hellenic Civil Aviation Authority (HCAA). According to the HCAA, total airport traffic in Greece through 2006 reached 40 million travelers, and is expected to increase to more than 50 million by 2010. Greece has 123 cargo/passenger ports that handle passenger ships, cruise ships and cargo. The main ports, so-called national ports, are Piraeus and Thessaloniki, serving as a gateway to the Balkans.

Significant developments that will influence demand for port safety and security include equipment upgrades associated with the Container Security Initiative (CSI) and/or International Ship and Port Facility Security Code (ISPS), as well as the HCAA’s plans for security upgrades. The ISPS Code defines, among other things, a series of mandatory measures to strengthen maritime security and prevent acts of terrorism against shipping and port facilities.

One offshoot of these requirements is the Greek Ministry of Merchant Marine’s plans to announce, by the end of 2008, an international tender worth more than $496 million for the design, implementation and operation of a fully integrated security system for 12 Greek national ports. The system will include surface, underwater and perimeter security according to the ISPS Code. A second tender will follow to cover the remaining Greek ports.

U.S. firms specializing in airport and port safety and security are uniquely qualified for projects in the above-cited areas, as U.S. companies enjoy an excellent reputation for high-quality equipment, advanced technology, superior technical proficiency, and expertise in the design and execution of large-scale security projects. Security products with new, innovative and sophisticated features are in demand in this sector, which offers excellent growth potential over the next several years. Despite strong competition from European companies, American companies have the potential to capture a significant share of this lucrative market.

Turkey:
Located at the crossroads of Europe, Asia and the Middle East, Turkey is prepared to defend its national interest along many different fronts. Turkey maintains the second largest land force in NATO and second largest fleet of F-16s, second only to the United States. Turkey’s role in NATO – including support of security initiatives and humanitarian operations in the region, as well as regional crisis management – is one of the cornerstones of the nation’s relationship with the United States. The FY 2007 Ministry of Defense (MOD) budget resulted in a 12% increase compared to FY 2006 and reached 13.2 billion in New Turkish Liras, constituting 2.1% of the gross national product (GNP). This does not include spending by either the Ministry of Interior’s Gendarme or the Under secretariat for Defense Industry procurements. Potential major procurements in 2008 are expected to include frigates, submarines, coastal surveillance radars, tactical wheeled vehicles, satellites, and air defense systems.

The safety and security market in Turkey is new and developing rapidly. The market size was estimated to be $3 billion in 2007 – approximately $2.5 billion of which was devoted to physical security services such as private security guards, patrols, and training. Biometrics, closed circuit systems (CCTV), access detectors, and X-ray equipment are among the best prospects for equipment. As Turkey’s economy continues to develop, the market for electronic security methods and services is expected to increase accordingly.

Israel:
In the homeland security, defense and aerospace sectors, U.S. exporters are the preferred suppliers for Israeli companies. The attractive dollar exchange rate, sophisticated technologies, cultural affinities, and strong political and commercial bonds between the United States and Israel are the main factors why Israeli manufacturers look to do business with U.S. firms.

Israel is a well-developed and sophisticated market for homeland security equipment and services. Israel’s security-awareness and high level of preparedness are the driving forces for the development of the country’s cutting edge security industry, which in 2007 produced an estimated $4.5 billion in equipment and services. Israel’s homeland security industry involves approximately 600 local firms.

Israel is an attractive market for U.S. manufacturers of high-end equipment and of components that can be integrated into Israeli systems. The import market, estimated at $510 million has a 70% U.S. market share. U.S. exporters dominate the market for sophisticated equipment used in homeland security applications. U.S. security equipment, which enjoys an excellent reputation in Israel due to its high reliability, is often used for sensitive applications, by high-security industries and for key infrastructures and installations. The market offers good opportunities for U.S. exporters of high-quality and sophisticated detection and screening systems, CCTV, sensors, biometric solutions, x-ray systems, and non-lethal weapons.

For U.S. exporters of defense systems and components, Israel offers excellent market potential. Estimated total market size is $3.5 billion, with imports totaling $2.5 billion. Over 70 percent of the $5.3 billion local production is exported. Import of defense items from the United States amounts to approximately $2 billion. Many procurements are made with Foreign Military Financing (FMF), giving a distinct advantage to U.S. manufacturers, as FMF requirements call for 51-percent U.S. content in purchased equipment.

Israel has a large and modern air force, successful international and regional airlines, hundreds of registered general aviation and sport aircraft, and an advanced aerospace industry. Israeli defense companies have developed and manufactured combat aircraft, business jets, missiles, unmanned aerial vehicles, space launchers, and satellites. Over the years, Israel has become a world leader in many aerospace fields.

The increasing needs of Israel’s growing defense and aerospace industries offer good opportunities for U.S. exporters. Selling to the Israeli military often involves the MOD’s mission in New York, and many of the major Israeli defense industries have offices and/or subsidiaries in the United States.

Mission Goals:

The trade mission’s goal is to provide market entry or increased sales in the mission markets for U.S. aerospace, defense and/or safety and security firms, as well as first-hand market information and access to potential business partners.

Mission Scenario:

The delegation will spend five days in Athens. In cooperation with CS Ankara and CS Istanbul, Turkish distributors, agents and other appropriate business partners will be invited to meet with the mission participants in Athens.

Mission participants may participate in an optional mission stop in Tel Aviv, Israel, where the CS will arrange one-on-one appointments with potential Israeli customers and/or business partners and provide briefings on the Israeli market. Companies opting to stop first in Israel will pay Gold Key Service fees directly to CS Tel Aviv.

In Greece, the U.S. Commercial Service will:

  • Provide a market briefing highlighting opportunities in the aerospace, defense and/or safety and security sectors.
  • Schedule one-on-one appointments at the Defendory show site with potential Greek and Turkish business partners.
  • Participate in the Defendory hospitality events to introduce participants to key business and industry officials.

Florida Governor Crist kick off trade mission to Europe, Russia

TALLAHASSEE, Fla. -- Gov. Charlie Crist kicks off an 11-day international trade mission, amid criticism that it's a costly and ill-timed trip.

The Republican governor is meeting with several businesses at the Farnborough International Air Show in England on Monday. Also on his itinerary are a nuclear waste processing plant in France, and meetings with officials in Spain and Russia. Crist says he hopes the trip will generate economic opportunities for Florida. Maryland Hosts Korean Food Buyers on Reverse Trade Mission

ANNAPOLIS, MD (July 10, 2008) - The Maryland Department of Agriculture, together with the Southern United States Trade Association (SUSTA), hosted a group of buyers representing some of the largest import, food service, and grocery retail companies in Korea on Thursday, June 26, and Friday, June 27. The group of six buyers traveled to Maryland to find suppliers for a wide variety of high-value processed food products. This reverse trade mission, which also included stops in Georgia and New York by the buyers, is a follow up to participation by MDA and SUSTA in the Seoul Food & Hotel Show in May.

"Korea is already one of the United States' most important agricultural trading partners," said Agriculture Secretary Roger Richardson, who welcomed the delegation during its stay in Maryland. "These activities provide a highly cost-effective way to tap into the third largest import market in Asia and preliminary sales results are very promising."

Log on http://www.midwestUSAChina.com

Three of the four suppliers exhibiting in Seoul Food and Hotel Show booked sales of more than $1.3 million and MDA anticipates that the two-day visit to Maryland alone will generate more than $500,000 in additional export revenues for local companies.

On Thursday, MDA organized an all-day series of meetings in Annapolis to give companies from around the state the opportunity to showcase their product lines. Attending Maryland companies included some of the state's best-known to one of its newest: Allied International, Glen Burnie; American Coffee Federation, Annapolis; Barcelona Nut and Tulkoff Food Products, Baltimore; Burris Logistics, Elkton, Dragonfly Farms, Mt. Airy; F.D. Trading, Reisterstown; Gifford's Ice Cream & Candy, Silver Spring; McCormick & Co., Sparks; Mama Vida's, Randallstown; Salter's Chesapeake Gourmet, Royal Oak; and Sea Watch International, Easton.

On Friday, the buyers toured McCormick's Hunt Valley plant, Tulkoff's new production facility in Dundalk, and Boordy Vineyards in Hydes. Site visits such as these underscore the scope and diversity of Maryland's products and help to create a broader understanding of agricultural resources within the state.

The delegation, accompanied by both MDA's International Marketing Specialist and the Market Promotion Specialist from the U.S. Agricultural Trade Office at the Embassy in Seoul, then attended the New York Fancy Food Show held on June 29 to July 1. The Fancy Food Show is one of America's oldest and largest food shows and features some of the most innovative and exotic specialty food processors from around the country and the world.

Almost 200 companies from the Southern region of the United States exhibited at the show, and among them were Gifford's as well as Really Raw Honey and The Seasoned Palate/tsp spices from Baltimore. The Korean buyers met with these companies and other regional suppliers during the show's run.

A highlight of each year's event is the awarding of the Silver and Gold sofi Awards for excellence in designated food categories. From a field of close to 2,100 entries, Baltimore's The Seasoned Palate and its tsp spices Sweet Basic package won not only two sofi Silvers, the first for Food Gift and a second for Innovation in Packaging Design or Function, but also garnered the Gold sofi Award for best Food Gift at the show.
